Buying or Selling a Property

This section contains information about the types of certificates you may need to obtain from Council when buying or selling a property. This information is provided as a guide only. You should always seek legal advice or consult your agent about your exact requirements.

Section 149D - Building Certificate

These certificates were previously dealt with under Section 172 of the Local Government Act 1993. Those provisions were transferred to the Environmental Planning and Assessment Act 1979. The fee in respect of these applications vary according to the building type and size, however in those cases involving residential development the fee is $210.00 for each dwelling contained in the building or in any other building contained on the allotment. Applications must be accompanied by a Registered Surveyor's Identification Report showing all buildings and improvements on the site.

Section 149 - Planning Certificate

A Planning Certificate provides information on how a property (such as vacant land, a house, a commercial building) may be used and the restrictions on its development. The detail which must be contained in the Certificate is specified by Section 149 of the Environmental Planning and Assessment Act. Items covered in the Certificate include a property's zoning, permissible and prohibited uses, whether the land is subject to any road widening, if the land is contaminated.

Planning Certificates cost $40.00 for what is known as a 149 Part(2) Certificate, and $100.00 for a 149 Part (2) and (5) Certificate. The different cost reflects the extra information provided in the more detailed Part (5) Certificate such as possible mine subsidence and flooding.
