Voluntary Planning Agreements (VPAs)
A Voluntary Planning Agreement (VPA) is a legal agreement between Bland Shire Council and a developer under Section 7.4 of the Environmental Planning and Assessment Act 1979.
VPAs provide a way for developers to make contributions towards public infrastructure, community facilities or other public benefits that support the needs of the community as development occurs. They are negotiated voluntarily and are separate from standard development contributions.
A VPA may be entered into as part of a planning proposal, development application or other planning process where it is considered appropriate.
VPAs cannot be entered into unless public notice has been given and an explanatory note is made available for inspection for at least 28 days.
VPAs can provide a range of public benefits, including:
- Public infrastructure such as roads, footpaths or drainage works
- Community facilities and public amenities
- The dedication of land to Council
- Financial contributions towards community infrastructure or services
- Environmental conservation or enhancement initiatives
- Affordable housing initiatives (where applicable)
- Other material public benefits that support the local community
The specific benefits provided under each agreement are negotiated on a case-by-case basis and are tailored to the individual development.
How can contributions be made?
- Under a Voluntary Planning Agreement, contributions may be provided in a number of ways, including:
- Monetary contributions
- Construction or delivery of public infrastructure
- Dedication of land to Council at no cost
- Provision of community facilities or services
- Other agreed material public benefits
The form of the contribution is determined through negotiations between Council and the developer and documented within the agreement.
Planning Agreement Register
In accordance with the Environmental Planning and Assessment Act 1979, Bland Shire Council maintains a public register of all Planning Agreements that have been entered into by Council.
The register provides access to current and historic Planning Agreements and any associated explanatory material where applicable.
